The following terms and conditions apply to all services, including website development and design services, (the Services) provided by Bakofys Limited to the Client, in conjunction with any relevant quotation provided to the Client by Bakofys Ltd (Terms), unless otherwise agreed in writing. Acceptance of a quote, purchase and/or use of the Services shall be considered acceptance of the Terms.
In these Terms and Conditions ‘We’ ‘Us’ or ‘Baskofys’ refers to the legal entity of Bakofys Ltd, registered in England, UK.
Some important notes
This method replaces the much higher development fee and has been noted to be far more affordable for customers.
The Bakofys monthly hosting fee is separate from Android and iOS hosting fee which at the time of writing is as follows:
Once you create an account, you have to wait 48 hours for Google to confirm your account. For free apps, Google charges no extra fee but it does take 30% revenue for paid apps on the platform.
Apple also gives an upgraded Enterprise account which costs 299$ per year. Apple may waive your fee if all the apps that you create and publish are free. Apps belonging to NPOs, government organisations also have their fees waived off.
Note: Fees may differ regionally.
The app created through Bakofys common plans such as the ‘Enterprise’ plan will reflect the content on the client’s website. Unless something minimal there will be little additions that can be made on the app that is not existent on the website.
Charges for the Services are defined in the project quotation that the Client receives from Bakofys Ltd via email. Quotations are valid for a period of 30 days. Bakofys Ltd reserves the right to alter a quotation or decline to provide the relevant Services after expiry of the 30 days.
Unless agreed otherwise with the Client, all website design services require an advance payment of a minimum of fifty (50) percent of the project quotation total before the work commences. A second payment of fifty (50) percent is required upon completion of the work, prior to upload to the server or release of materials.
The Client agrees to reimburse Bakofys Ltd for any additional expenses necessary for the completion of the work. Expenses may include (but are not limited to) purchase of domain names, special fonts and stock photography.
All Charges are inclusive of VAT.
Bakofys Ltd shall submit invoices in line with the timescales above. Invoices are normally sent via email, but hard copy invoices are available on request. Payment is due on receipt of the invoice by the Client.
Payment for services is due by bank transfer. Bank details will be made available on invoices.
If the Client fails to make any payment due to Bakofys Ltd by the due date for payment, then, Bakofys Ltd will not be in a position to initiate any work in behalf of the client until the correct payment has been made. In any case, subject to workload a maximum of thirty (30) days will be given whereupon Bakofys Ltd will consider the contract as cancelled, and if the client desires the same project a new contract will have to be put in place.
Accounts unpaid thirty (30) days after the date of invoice will be considered in default. If the Client in default maintains any information or files on Bakofys Ltd’s web space, Bakofys Ltd will, at its discretion, remove all such material from its web space. Bakofys Ltd is not responsible for any loss of data incurred due to the removal of the service. Removal of such material does not relieve the Client of the obligation to pay any outstanding charges assessed to the Client’s account. Clients with accounts in default agree to pay Bakofys Ltd reasonable expenses, including legal fees and costs for collection by third-party agencies, incurred by Bakofys Ltd in enforcing these Terms.
Bakofys Ltd will provide the Client with an opportunity to review the appearance and content of the website during the design phase and once the overall website development is completed. At the completion of the project, such materials will be deemed to be accepted and approved unless the Client notifies Bakofys Ltd otherwise within three (3) days of the date the materials are made available to the Client.
Bakofys Ltd will install and publicly post or supply the Client’s website by the date specified in the project proposal, or at the date agreed with Client upon Bakofys Ltd receiving initial payment, unless a delay is specifically requested by the Client and agreed by Bakofys Ltd.
In return, the Client agrees to provide Bakofys Ltd promptly with all necessary co-operation, information, materials and data, access to staff and timely decision-making which may be reasonably required by Bakofys Ltd for the performance of the Services. This shall include the Client delegating a single individual as a primary contact to aid Bakofys Ltd with progressing the commission in a satisfactory and expedient manner.
During the project, Bakofys Ltd will require the Client to provide website content; text, images, movies and sound files, along with any relevant background information.
Bakofys Ltd is a small business, and to remain efficient we must ensure that work we have programmed is carried out at the scheduled time. On occasions we may have to reject offers for other work and enquiries to ensure that your work is completed at the time arranged. This is why we ask that the Client provides all the required information in advance.
If the Client agrees to provide us with the required information and subsequently fail to do within two weeks of project commencement we reserve the right to close the project and the Client will be liable for ten (10) percent of the full payment immediately. Simply put, do not give us the go ahead to start until you are ready to do so.
NOTE: Text content must be delivered as a Microsoft Word, email (or similar) document with the pages in the supplied document representing the content of the relevant pages on your website. These pages must have the same titles as the agreed website pages. Contact us if you need clarification on this.
Using our content management system the Client will be able to keep the content up to date themselves. If so desired our services for this and other aspects of the website can be availed at an additional cost.

As such, Bakofys Ltd reserves the right to quote for any work involved in changing the website design or website code for it to work with updated browser software.
Termination of services by the Client must be requested clearly via email (to enq@bakofys.com) and will be effective on receipt of such notice. Telephone or text requests for termination of services will not be honoured until and unless confirmed via email. The Client will be invoiced for work completed (including any expenses incurred, as outlined in clause 1) to the date of first notice of cancellation for payment in full within thirty (30) days.
If an acknowledgement email has not been received by the Client, the Client must assume that the email has not been received and would need to resend the email until an acknowledgement has been received.
All Bakofys Ltd services may be used for lawful purposes only. The Client agrees to indemnify and hold harmless Bakofys Ltd against all damages, losses and expenses arising as a result of any and all actions or claims resulting from the Client’s use of Bakofys Ltd’s service.
